These Terms apply regardless of the means of delivery of the website to you.

By using our website (regardless of whether you register with us), you indicate that you have read and accept these Terms (as modified from time to time). Your continued use of this website constitutes your agreement to these Terms and your consent for us to collect, use and disclose your personal information in accordance with our privacy policy. Macmillan takes all reasonable steps to ensure the accuracy and completeness of the information available on our website that has not been supplied by a third party. Due effort has been made to contact copyright holders of material that appears on the website. If we have been unable to contact you, please contact us so that we may rectify the position.

Any material you send to us on or via our website will be deemed to be non-confidential and non-proprietary unless it is indicated otherwise. This includes any data, questions, comments, suggestions, ideas or other information. We will be entitled to use any such material which has not been indicated to be confidential or proprietary for any purpose at our discretion.

Conditions of Purchase

In the online Macmillan bookshop at macmillanbookshop.com.au (“Online Bookshop’), Macmillan offers print books in paperback and hardback formats as well as electronic books (“Ebooks”).

By placing an order through our Online Bookshop you are offering to purchase the goods on and subject to these Terms.

Macmillan reserves the right at its sole discretion not to supply certain customers, to apply limitations of quantity or value, and to rescind acceptance, in whole or in part, of any order containing incorrect information, whether this results from technical malfunction or any other cause, or in cases where the order is in conflict with the conditions of purchase.

When you make an order, you will receive an acknowledgment email confirming receipt of your order.  This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved and our billing agent has debited your credit or debit card.

Your Account

You must be a registered member to make orders in the Online Bookshop. Please ensure that when you register and activate your account, you provide us with accurate and current personal information as we will send you an email to verify your account.  You will also receive a verification email when you subscribe to access licensed material under an individual or institutional licence.

You are responsible for keeping your username and password details secure and for all use and activity carried out under your username.

Pricing

All of our prices are in Australian dollars (AUD) and include GST (Goods and Services Tax). Product prices are regularly updated when price changes are received from our suppliers.

Any order originated and processed by Macmillan is processed in Australian dollars (AUD).

Credit/Debit Card Payment Security

Any financial information you provide to our website is not held by Macmillan, it is directed to our billing agents who ensure the highest security for the processing of your credit/debit card transactions. Data is encrypted for the customer’s safety. Macmillan cannot be held responsible for a security failure originated with our billing agents or other suppliers.

When making a purchase through the Online Bookshop, you will be given the opportunity to review your order, shipping details and provide your credit or debit card information (Visa or Mastercard only). After entering your financial information and submitting your order, you will receive confirmation as to the success or failure of your transaction.

Payment of Macquarie Dictionary licence fees is also processed by third party billing agents. Macmillan does not have access to card details unless a customer calls Customer Support and asks a member of staff to process a payment on their behalf. In this case the customer’s card details will be entered onto the system by Customer Support but the information is not stored by Macmillan.

Your Order

  1. Print Publications

Our suppliers use reasonable endeavours to maintain the stock of our goods to meet the orders made through our website. All orders are subject to availability and confirmation of the order price.

Delivery

Macmillan ships goods Australia-wide, to New Zealand and internationally using a range of carriers. Shipping costs are influenced by the location. Exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout. Total costs of the goods or services offered include all appropriate shipping/handling charges and taxes. International orders of high-unit quantities may incur manual delays and additional freight charges.

Orders are dispatched within 2-4 business days. Shipping times are estimated at between 1-7 business days depending on your location within Australia and 3-10 business days to New Zealand. For international orders the shipping service is not traceable and can take up to a month to arrive. Items on one order are sent to the same delivery address. If an item increases in price during the period between order and dispatch, Macmillan will pay the difference on behalf of the customer.

Customers are responsible for paying any import costs such as customs duties, taxes (including sales tax, value-added tax and GST) and clearing fees, upon delivery.

Cancellation

You may cancel your order, in part or in whole, within 24 hours of ordering by contacting us at adscs@alliancedist.com.au or calling +61 2 4390 1300, Monday to Friday 9.00 am to 5.00 pm (AEST). Once you cancel an order any sums due to you will be re-credited to your account within 30 days. If your order has already been shipped, please refer to Returns and Refunds below.

Returns and Refunds

Our books come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement of refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You may also be entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. If you have a misprinted or faulty book, please email us at support@macmillan.com.au with a photo of any faulty pages along with the copyright page so we can investigate further.

  1. Ebooks and audiobooks

Delivery

Purchased digital content shall be delivered to you by making the ebook or audiobook available in electronic format. Ebook and audiobook purchases are restricted to your Glassboxx account.

If you download digital content, the file may be stored on the end device that you use personally. The following in particular are not permitted:

  • making unauthorised additional copies, in particular on end devices or media to which third parties have access;
  • adapting digital content, and publishing or exploiting the item thus made;
  • passing on digital content to third parties, or making it available to the public (including intranets).

The above rules apply to digital content in its entirety as well as any part that is protected by copyright (individual chapters/articles, photographs, diagrams etc.)

Cancellation, Returns and Refunds

Customers are not entitled to refund or return an ebook or audiobook. Macmillan will resupply corrupted, incomplete or incorrectly supplied ebooks or audiobooks through our websites if notified within 48 hours of purchase. Macmillan will not resupply an ebook or audiobook that has been lost due to system failure, accidental deletion or other causes beyond Macmillan control. It is your responsibility, once supplied, to ensure the security and integrity of the ebook or audiobook files, within the limitations of the licence granted on purchase of the ebook or audiobook.

All apps advertised on the Macmillan websites are purchased through iTunes or Google. All enquiries relating to apps advertised on the Macmillan websites should be directed to iTunes or Google.

Our Liability

This Website is provided by Macmillan on an ‘as is’ and ‘as available’ basis. To the maximum extent permitted by law, Macmillan excludes all liability for any loss or damage of any kind (including special, indirect or consequential loss and including loss of business profits) arising out of or in connection with the website content and the use or performance of the Macmillan website.

To the full extent permissible by applicable law, Macmillan disclaims all guarantees, warranties, and representations, express or implied. Nothing in these terms excludes, restricts or modifies any right, remedy, guarantee or warranty, implied or imposed by any legislation which cannot lawfully be excluded or limited. This may include the Australian Consumer Law which contains guarantees that protect consumers when acquiring goods or services.

General 

These Terms are governed by New South Wales law. Any grievance or dispute is subject to the non-exclusive jurisdiction of the Australian courts.

If any of these Terms is (for any reason) held to be unenforceable, illegal or in some other way invalid, the remainder of these Terms will continue in full force and effect.
